The Allahabad High Court’s intervention highlights the urgency of forming an OBC Commission to ensure compliance with Supreme Court mandates ahead of the 2026 Panchayat elections. The court issued a notice to the Uttar Pradesh Government, demanding an affidavit specifying a timeline for this formation within three weeks.

Advocate Moti Lal Yadav filed a contempt petition, alleging that state authorities willfully ignored previous orders. The next hearing is scheduled for May 19, 2026. This timeline is critical; delays in forming the OBC Commission could lead to postponing local body polls to 2027.

The Supreme Court’s ‘Triple Test’ criteria must be followed for OBC reservation in local bodies — established in the Vikas Kishanrao Gawali case. These criteria require empirical data for seat allocation, a stipulation rooted in the UP Panchayat Raj Act of 1947.

Similarly, Agonda Panchayat was recognized for its outstanding commitment to waste management facilities.

The current situation presents a stark divide; while some local bodies excel, others face bureaucratic hurdles that threaten their electoral integrity. The ongoing preparations by the State Election Commission for three-tier Panchayat elections scheduled from April to July 2026 further complicate matters.

Ultimately, as officials scramble to comply with legal standards and ensure fair representation for OBCs, uncertainty looms large over how these developments will shape local governance in Uttar Pradesh.
